CITY OF MONROE NO. 11,876 ___
The following Ordinance was introduced by Echols who moved for its adoption and was seconded by Wilson :
AN ORDINANCE AMENDING CHAPTER 12 SECTION 114 ENTITLED “POSSESSION OF DRUG PARAPHERNALIA” OF THE MONROE CITY CODE, AND FURTHER PROVIDING WITH RESPECT THERETO:
WHEREAS, the City of Monroe has adopted Chapter 12 of the Monroe City Code dealing with criminal offenses; and
WHEREAS, Section 114 of Chapter 12 entitled “Possession of drug paraphernalia” needs to be amended; and
NOW THEREFORE BE IT ORDAINED by the City Council of the City of
Monroe, Louisiana, in legal session convened, that Chapter 12, Section 114 of the Monroe City Code be amended as follows:
Sec. 12-114. - Possession of drug paraphernalia.
(a) It shall be unlawful for anyone to possess drug paraphernalia.
(b) As used in this section, unless the context clearly indicates otherwise, the term "drug paraphernalia" shall mean and include, but not be limited to any and all definitions and/or meanings indicated in R.S. 40:1021 et seq.
(c) In determining whether an object is drug paraphernalia, a Monroe City Court shall consider, in addition to all other legally relevant factors, all matters indicated and/or included in R.S. 40:1021, et seq.
(d) To the fullest extent of the law, the city adopts by reference all provisions of the State Law of Louisiana which are or may be necessary to enforce the prosecution and/or execution of this law.
(e) Whoever commits the crime of possession of drug paraphernalia may be imprisoned for not more than six (6) months or fined not more than five hundred dollars ($500.00), or both.
