            The following Ordinance was offered by Ms.  Woods                      who moved for its adoption and was seconded by Mr.   Wilson                               :

AN ORDINANCE AMENDING CHAPTER 37, ZONING, ARTICLE IX. ADMINISTRATION AND ENFORCEMENT, SECTION 37-130 PROCEDURES, OF THE CODE OF THE CITY OF MONROE.OF THE ORDINANCE OF THE CITY OF MONROE, LOUISIANA; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH.

WHEREAS, the City Council of the City of Monroe has this date held its Public Hearing with respect to the following proposed amendment to Chapter 37, Zoning, Article IX. Administration and Enforcement, Section 37-130 Procedures of the Code of the City of Monroe. and

            WHEREAS, the City Council has further considered the recommendation of the Monroe Planning Commission recommending approval on a 4-0-1 vote and that the above stated Sections of the Zoning Ordinance of the City of Monroe should be amended.

            NOW, THEREFORE;

BE IT ORDAINED, by the City Council of the City of Monroe, Louisiana, in legal session convened, that Chapter 37, Zoning, Article IX, Administration and Enforcement, Section 37-130, Procedures of the Zoning Ordinance of the City of Monroe be and it is amended as follows:

SECTION 37-130. PROCEDURES

(a) Common Review Procedures

            (5) Public notice and hearings

                        b. Notice of Public Hearing: all notices for public hearing (except posted notices)

(c) Administration Adjustment

    (6) Expiration – An Administrative Adjustment shall not expire.

      (d)  Variance

(7) Expiration. A variance runs with the land and does not expire unless the board of adjustment or the 4th Judicial District Court assigns an expiration date as a condition.

 A variance approved by the Board of Adjustment shall expire six (6) months from the date of approval if the applicant fails to obtain a Zoning Compliance Verification form and any appropriate building permits. Applicants may file for one six (6) month extension of the variance approval, in writing, with the planning and zoning director or his/her designee subject to administrative approval.

 (f) Major and minor conditional use permits

3. Applicants may file for one six (6) month extension of the conditional use approval, in writing, with the planning and zoning director or his/her designee subject to administrative approval.

 (j)Certificates of Appropriateness for historic district.

(7) Expiration – The Certificate of Appropriateness (COA) approved by the Commission shall expire six (6) months from the date of approval if the applicant fails to obtain a Zoning Compliance Verification and the appropriate building permits. This deadline may be extended upon a request to the Commission before the six (6) months is up.

(l) Fence Permit

(7) Expiration – A fence permit shall not expire.

            This ordinance was INTRODUCED on the 9th of October 2018.

NOTICE PUBLISHED on the  12th  day of  October          , 2018.

This Ordinance having been submitted in writing, introduced and published was then submitted to a final vote, the vote thereon being as follows:

AYES:            Echols, Ezernack, Woods, Wilson & Clark

NAYS:             None.

ABSENT:       None.

            And the Ordinance was declared ADOPTED on the  23rd     day of  October , 2018
